FIFA Threatens World Cup Blog with Legal Action
Posted below is an unedited email that World Cup Blog received from FIFA earlier this week. In English, German, and Spanish the world’s football governing body explains that our site has allegedly violated their copyright and trademark regulations. Ms. Karen Fan – an ironic last name if ever there was one – writes, “Such activity is likely to cause material damage and harm to FIFA and its sponsors or licensees.” If by promoting the World Cup, getting fans excited about the event and providing news about the teams that you can’t find elsewhere in English is materially damaging FIFA, Budweiser, Mastercard, et al., then we plead guilty.
The timing of such a message was not lost on us. Two days after FIFA posted $164.9 million in profits for 2005 it sends this message to a site whose operators are happy when they find some loose change underneath the cushions of their couch.
Somehow we don’t think we are the only ones who are in Ms. Fan’s email address book. Take a look around cyberspace and you’ll see everyone from the BBC, to the Washington Post and countless other smaller sites using FIFA’s silly little Photoshop logo. Some of them might have the authorization of Sepp Blatter and his buddies in Geneva, but most do not.
We have complied with FIFA’s request but not because we agree in the least with their draconian rules. We are just nice people and the only lawyer we could afford to hire to represent us in this dispute was our brother-in-law whose entire legal education comes from watching Perry Mason, LA Law and Law and Order.

I am writing on behalf of the Federation Internationale de Football Association (FIFA) with respect to the 2006 FIFA World Cup(tm). FIFA owns the exclusive rights around the world in a number of trade marks and copyright works created for the tournament, including but not limited to the Official Emblem, Mascots, FIFA World Cup Trophy and numerous word marks such as FIFA WORLD CUP (the “FIFA Marks”). FIFA has various exclusive contractual arrangements in place with sponsors and licensees around the world relating to the exploitation of such rights in accordance with strict terms. Please see the attached information sheet.
We have discovered that FIFA’s Marks are being misused in the following way on the website under your control and/or legal ownership at: *http://www.worldcupblog.org/*
** Unauthorised use of FIFA’s copyright and trade mark protected logos
1) the Official Emblem of the 2006 FIFA World Cup and
2) the FIFA World Cup Trophy, in relation to the unauthorised sale of tickets. (The Local Organising Committee of the 2006 FIFA World Cup will contact you separately on the issue of tickets). *
FIFA has not consented to this activity and consequently, this is a clear infringement of FIFA’s rights and/or a misuse of FIFA’s marks. Such activity is likely to cause material damage and harm to FIFA and its sponsors or licensees.

I’m sure they feel contractually bound to send cease-and-desist letters like that for the sake their IP and their sponsors, but crimminy, why are they so hostile to fans? Well, at least the World Cup is great in spite FIFF’s best efforts.

Can’t say I blame FIFA. Trademark laws being what they are, FIFA has to err on the side of paranoia just so it can set a precedent for protecting their marks.
It might seem trivial and counterproductive to go after sites like this blog, it really doesn’t have a choice if it wants to make sure their trademarks aren’t abused.
Intellectual property laws are to blame here, not FIFA.

That is just a straight form-email-letter with an “insert url here” field for one of Ms. Fan’s underlings to send out to anyone who uses the word “FIFA”.
I will probably get the same form-email-letter for using the word “FIFA” when referring to the “FIFA WORLD CUP” in response to this blog post and voicing my opinion of the “FIFA” logo on one of my sites like this: http://www.eastsidecrew.com/2006/04/16/dear-fifa/

we had the same email too, if you look @ our banner we had a symbol of the world cup replacing the ‘i’ in Daily.
it looked quite cool too and then a week later we get the same email.
Were currently working on a new design of a golden penis with Sepp Blatters head ontop replacing the globe.
